The Matrimonial Property Act No. 88 of 1984 in section 21 provides that a married couple may jointly apply to Court in order to amend the matrimonial property regime applicable to their marriage, regardless of how and when they were married. According to South African law couples are deemed to be married in community of property, if the spouses have not signed and registered an ante-nuptial contract with the registrar.
